Welcome to HengSheng. These Terms of Service ("Terms") govern your use of the HengSheng mobile application ("App") operated by HumanSmart Group Inc. ("Company", "we", "us"). By using the App, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and a licensed insurance agent or authorized representative to use this App. By registering, you confirm that you meet these requirements and that all information provided is accurate.

2. Account Registration

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You must notify us immediately of any unauthorized use of your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

3. Permitted Use

The App is designed to assist insurance agents with:

  • AI-powered real-time sales coaching and training
  • Marketing content generation and distribution
  • Team management and performance tracking
  • Client communication and lead management
  • Professional development and compliance training

4. Prohibited Conduct

You agree NOT to:

  • Use the App for any unlawful purpose or in violation of insurance regulations
  • Misrepresent AI-generated coaching suggestions as guaranteed outcomes
  • Share your account credentials with unauthorized persons
  • Record or distribute client conversations without proper consent
  • Use the App to make misleading or non-compliant insurance claims
  • Attempt to reverse-engineer, decompile, or hack the App
  • Violate any applicable insurance industry regulations or compliance requirements

5. AI-Powered Features

The App uses artificial intelligence to provide coaching suggestions, content generation, and analytics. Please note:

  • AI suggestions are for reference only and do not constitute professional advice
  • You are responsible for verifying the accuracy and compliance of any AI-generated content before using it with clients
  • AI coaching is supplementary and does not replace professional training or compliance obligations
  • AI model outputs may occasionally be inaccurate or inappropriate; use professional judgment

6. Audio Recording and Processing

  • The App may record and process audio during coaching sessions with your explicit consent
  • You are solely responsible for obtaining consent from all parties before recording any conversation
  • You must comply with all applicable wiretapping and recording laws in your jurisdiction
  • Audio data is processed per our Privacy Policy

7. Intellectual Property

  • The App, its features, and content are owned by HumanSmart Group Inc.
  • Marketing materials generated through the App may be used by you for business purposes
  • You retain ownership of your personal data and client information
  • You may not copy, modify, or distribute the App or its proprietary content

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE:

  • Uninterrupted or error-free service
  • Accuracy of AI-generated coaching suggestions or content
  • Specific sales outcomes or performance improvements
  • Compatibility with all devices or operating systems

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HUMANSMART GROUP INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST SALES, OR REGULATORY PENALTIES.

10. Compliance

You agree to:

  • Comply with all applicable insurance industry laws and regulations
  • Follow your state's insurance department guidelines
  • Not use the App in a way that violates compliance requirements
  • Report any compliance concerns to your supervisor and our support team

11. Termination

We may terminate or suspend your access at any time, with or without cause. Upon termination, your right to use the App ceases immediately. Data deletion requests can be submitted via our Data Deletion page.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the App. Continued use after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
